The Platform is provided on an "as-is" basis for informational and analytical purposes. While we strive to provide accurate and useful insights, the Platform is a support tool and should not be relied upon as a substitute for professional judgment, expert review, or formal verification.

2. Definitions

  • "User," "You," "Your": Any individual or organization that accesses or uses the Platform.
  • "Account": Your registered user profile and associated subscription.
  • "Content": Any documents, files, data, or information you upload to the Platform.
  • "AI Output": Any analysis, BOQ extraction, cost estimation, or other results generated by our AI systems.
  • "Confidential Information": Any proprietary or sensitive data you upload to the Platform.

3. Use of Service

3.3 Account Responsibility

You are responsible for maintaining the confidentiality of your login credentials, notifying us immediately of any unauthorized access, all activities conducted under your Account, and ensuring your use complies with all applicable laws.

4. User Responsibilities

4.1 Content Ownership & Rights

You retain ownership of all Content you upload to the Platform. By uploading Content, you grant us a non-exclusive, worldwide license to process and analyze your Content using our AI systems, store your Content securely on our servers, and use aggregated, anonymized data to improve our Platform (with your consent).

4.2 Confidentiality & Data Sensitivity

IMPORTANT: You are solely responsible for determining whether your Content is appropriate to upload to the Platform.

  • Do not upload confidential, proprietary, or sensitive information unless you have explicit authorization
  • Do not upload personal data unless necessary for the Platform's function
  • Do not upload information subject to non-disclosure agreements or legal restrictions
  • We are not responsible for any breach of confidentiality resulting from your decision to upload restricted information

4.3 Accuracy & Verification

You acknowledge that AI-generated outputs may contain errors, omissions, or inaccuracies. You are responsible for independently verifying all AI Output before relying on it. You should not make critical business decisions based solely on Platform outputs. Professional review by qualified engineers, architects, or estimators is strongly recommended.

9. AI Disclaimer

9.1 AI-Generated Content

The Platform uses artificial intelligence to analyze documents and generate outputs. You acknowledge and agree that:

  • AI outputs may be inaccurate: AI systems can make mistakes, misinterpret data, or produce incorrect results
  • No guarantee of completeness: AI Output may miss relevant information or overlook important details
  • Probabilistic nature: AI systems generate outputs based on patterns and probabilities, not deterministic logic
  • Continuous improvement: We are constantly improving our AI, but accuracy is never guaranteed

9.2 Human Review Required

You must independently verify all AI Output before relying on it for any business decision.

Recommended verification steps include manual review by qualified professionals, cross-referencing with original source documents, comparison with industry standards and best practices, and consultation with domain experts.

10. Accuracy Disclaimer

10.1 No Warranty of Accuracy

CRITICAL: The Platform makes no warranty regarding the accuracy, completeness, or reliability of AI Output, including Bill of Quantities extractions, cost estimations and pricing predictions, market research and benchmarking data, and risk assessments and project insights.

10.2 Tender & Project Risks

We are not responsible for loss of tenders or contracts due to inaccurate BOQ, financial losses resulting from incorrect cost estimations, project delays or cost overruns caused by reliance on Platform outputs, errors in quantity calculations or item descriptions, or missed items or incomplete BOQs.

10.3 Professional Responsibility

You acknowledge that tender preparation and cost estimation require professional expertise. The Platform is a support tool, not a substitute for qualified professionals. Your organization remains fully responsible for all tender submissions and project decisions.

11. Limitation of Liability

11.1 Disclaimer of Damages

To the maximum extent permitted by law, TenderIQ shall not be liable for indirect damages (lost profits, lost revenue, lost data), consequential damages, special damages, or financial losses related to tenders, contracts, projects, or business decisions.

11.2 Liability Cap

Our total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the total amount you paid for your Subscription in the 12 months preceding the claim.

15. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws applicable to the jurisdiction where the Platform is primarily operated, without regard to conflict of law principles.
